Dar es Salaam, Kisutu Resident Magistrate’s Court rejected application by Bongo film actress Elizabeth Michael alias Lulu to transfer her case to junior court.
Lulu through her advocate Kennedy Fungamtama made the application today before resident magistrate Augustino Mbando that his client’ age is below 18 years os that the case should be in juvenary court.
“We are asking the court to transfer the case to junivery court because my client has seventeen years of age,” asked Fungamtama.
Replying on the request, prosecution led state attorney Elizabeth Kaganda informed the court that the application was premature since investigation of the case is not completed.
Kaganda further told the court that, age of the accused are among the issues that are investigating.
On his side, magistrate Mbando said that, the lower court has no jurisdiction to entertain any application because the case before the court is murder.
Magistrate Mbando advised, the application to be made when the court reach to the High Court.
In the case, Lulu is charged with murdering a movie local star Steven Kanumba on April 7, 2012 this year at Sinza Vatican.
Kanumba who is died and burred last this Month is said to have embroiled in brawl with his girlfriend Lulu at his home Sinza. Muhimbili national hospital doctor’ report shows that, Kanumba died on brain injury caused by a heavy brawl on the head.
